Nicaragua: Trade unions regulate subcontracting and outsourcing in construction

SNSCAASC and FITCM-N, BWI affiliates in Nicaragua, signed a Regulatory Framework Agreement with the Nicaraguan Chamber of Construction (CNC) to ensure workers from subcontracting companies and outsourcing agencies receive legal and occupational protection, in accordance with the current Collective Bargaining Agreement for the construction sector in the country.

The Regulatory Framework Agreement state, "construction companies, employers, developers and others engaged companies in the construction industry that use subcontractor companies’ services will comply with the legal obligations established in the law.” The agreement also establishes that companies that contract services of a third party developers or subcontractors will be responsible to the labor authorities in case of non-compliance.

In addition to the current Collective Bargaining Agreement signed between SNSCAASC, FITCM-N with the CNC, obligations include Social Security, inscription in the Nicaraguan Institute of Social Security (INSS), Social Security Law, and Occupational Health and Safety Law.
